Overview

This website is operated by Brite Ideas Decorating, Inc., which runs the ChristmasLand Drive-Thru ("ChristmasLand", "we", "us" and "our"). We offer this website, including all information, tools and services available from it, and the ChristmasLand Drive-Thru itself, to you, the user, on the condition that you accept all of the terms, conditions, policies and notices stated here.

By visiting our site, buying tickets or gifts, or attending ChristmasLand, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here or available by link, such as our Privacy Policy. These Terms apply to all users of the Service, including browsers, customers, gift recipients and guests. If you do not agree to all of these Terms, you may not use the Service.

Any new features added to the Service are also subject to these Terms. We may update, change or replace any part of these Terms by posting updates on this page. Your continued use of the Service after changes are posted means you accept them.

Section 1 – Tickets and Admission

• One ticket admits one vehicle, however many people are inside, during the night and 30-minute arrival window shown on the ticket. Please arrive within your window. Gates close at 10:00 PM.
• Vehicle limits: vehicles may be no more than 8 ft high and 9 ft wide. No buses, limousines, RVs or oversized vehicles. Everyone must stay inside the vehicle for the whole drive.
• Each ticket's QR code can be used once. Show it at the gate on your phone or printed. Keep it private: whoever presents it first is admitted, and a copied or shared code will not be admitted again.
• Please follow the directions of our staff and posted signs, drive slowly and stay on the marked route. We may refuse admission to, or ask to leave, any vehicle or guest who does not, or whose conduct is unsafe, without a refund.
• Tickets are for personal use and may not be resold for more than their face value. We may cancel tickets obtained in breach of these Terms.

Section 2 – Changes, Refunds and Closures

• Tickets are non-refundable, but you may change your night or arrival window free of charge, subject to availability, any time before your visit, using the link in your confirmation.
• ChristmasLand is an outdoor event. We may delay opening, shorten a night or close a night for weather, safety or other conditions beyond our control. If we close a night, your tickets stay valid and you may choose another night free of charge; we will tell you by email (and by text, if you agreed to texts).
• Unused tickets are not refunded, and a missed arrival window or night is not refunded. Please change your night in advance instead.

Section 3 – Gifts

A ChristmasLand gift entitles its recipient to the number of vehicles shown, on a night of their choosing, subject to availability, during the season it was bought for. We deliver gifts by email to the address the buyer provides, on the date the buyer chooses. Gifts cannot be exchanged for cash.

You must be at least 18 years old, or the age of majority where you live, to buy tickets, and you may not use the Service for any illegal or unauthorized purpose. We reserve the right to refuse service to anyone for any reason at any time. Your content (not including payment card information) may be transferred over networks; payment card information is always encrypted and is handled by our payment processor. You agree not to reproduce, duplicate, copy, sell or exploit any portion of the Service without our written permission.

Section 6 – Accuracy, Completeness and Timeliness of Information

We are not responsible if information on this site is not accurate, complete or current. Material on this site is provided for general information only. We may change the contents of this site at any time, but we have no obligation to update any information. It is your responsibility to monitor changes to our site.

Section 7 – Modifications to the Service and Prices

Ticket prices are plus applicable sales tax, shown before you pay. Prices for tickets are subject to change without notice, but a change never affects tickets you have already bought. We reserve the right to modify or discontinue the Service, or any part of it, without notice. We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Section 8 – Availability

Each night and arrival window has limited capacity, and tickets are sold on a first-come basis. A ticket or window shown as available is reserved for you only while you complete checkout within the time shown. We may limit the number of tickets per order or per customer.

Section 9 – Accuracy of Billing and Contact Information

We reserve the right to refuse or cancel any order, including orders that appear to be placed by resellers or fraudulently. If we cancel an order, we will try to notify you using the email or mobile number provided. You agree to provide current, complete and accurate purchase and contact information, so that we can deliver your tickets and reach you about your visit.

Section 10 – Optional Tools

We may provide access to third-party tools, such as payment methods, that we neither monitor nor control. These are provided "as is" and "as available" without warranties of any kind, and your use of them is at your own risk and subject to the terms of the relevant provider.

Links on this site to third-party websites are provided for convenience. We are not responsible for the content, accuracy or practices of third-party websites, or for any purchases or transactions made with them.

Section 12 – User Comments, Feedback and Other Submissions

If you send us comments, suggestions, reviews or other material, you agree that we may, at any time and without restriction, edit, copy, publish, distribute and otherwise use them, without compensation to you. You agree that your submissions will not violate the rights of any third party or contain unlawful, abusive or obscene material.

Your submission of personal information is governed by our Privacy Policy.

Section 14 – Errors, Inaccuracies and Omissions

Information on our site or in our messages may occasionally contain typographical errors, inaccuracies or omissions relating to dates, arrival windows, pricing or availability. We reserve the right to correct any errors and to change or update information, or to cancel orders affected by such an error, at any time without prior notice, including after you have submitted an order. If we cancel an order because of an error, we will refund what you paid.

Section 15 – Prohibited Uses

You may not use the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any laws or regulations; to infringe our intellectual property rights or those of others; to harass, abuse, insult, harm, defame or discriminate; to submit false or misleading information; to upload viruses or other malicious code; to collect or track the personal information of others; to spam, phish, scrape or crawl; to buy tickets by automated means; or to interfere with or circumvent the security features of the Service. We may terminate your use of the Service for violating any of these prohibitions.

Section 16 – Disclaimer of Warranties; Limitation of Liability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. The Service and all tickets and services delivered through it are provided "as is" and "as available", without any representation or warranty of any kind, express or implied, except as required by law.

To the fullest extent permitted by law, in no case shall Brite Ideas Decorating, Inc., ChristmasLand, our directors, officers, employees, affiliates, agents or contractors be liable for any injury, loss, claim or any indirect, incidental, punitive, special or consequential damages of any kind, arising from your use of the Service or attendance at ChristmasLand, even if advised of their possibility. Our total liability for any claim relating to a ticket is limited to the amount you paid for it. You attend at your own risk and are responsible for your vehicle and its occupants. Some places do not allow these limitations, so they apply only to the extent permitted by law.

Section 17 – Indemnification

You agree to indemnify, defend and hold harmless Brite Ideas Decorating, Inc., ChristmasLand and our affiliates, officers, employees and agents from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Section 18 – Severability

If any provision of these Terms is found unlawful, void or unenforceable, it shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed; the remaining provisions remain valid and enforceable.

Section 19 – Termination

These Terms are effective unless and until terminated by you or us. If we determine that you have failed to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and deny you access to the Service. Your obligations incurred before termination survive it.

Section 20 – Entire Agreement

These Terms and any policies or operating rules we post on this site or at ChristmasLand constitute the entire agreement between you and us and supersede any prior or contemporaneous agreements, communications and proposals. Our failure to exercise or enforce any right or provision of these Terms shall not be a waiver of it.

Section 21 – Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law rules.
